Epic Games Settles with Samsung

After suing Apple and Google for mobile app antitrust violations, Epic Games sued Samsung for colluding with Google to prevent competition on Android. But today, just two days before Samsung’s big Galaxy Unpacked event, Epic Games revealed in a court filing that it’s reached a settlement with Samsung.

“Plaintiff Epic Games, Inc. has reached a settlement agreement with Defendants Samsung Electronics and Samsung Electronics America (together, ‘Samsung’),” the brief filing reads. “Pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(i), Epic hereby gives notice that Counts 1–5, 6, 7, 9, 11 and 13 of the First Amended Complaint are hereby voluntarily dismissed, without prejudice.”

“We’re dismissing our court case against Samsung following the parties’ discussions,” Epic CEO Tim Sweeney tweeted. “We are grateful that Samsung will address Epic’s concerns.”

How Samsung is addressing its complaints is unclear. But when Epic Games sued the company, it accused Samsung–the world’s biggest maker of Android devices–of colluding with Google to help it prevent the distribution of the Epic Games Store after Google lost Epic v. Google. It also accused Samsung of enabling an Auto Blocker by default specifically to thwart the Epic Games Store.

Epic co-sued Google when it sued Samsung, noting that its defeat in Epic v. Google prevents it from entering into agreements with partners to block competition. That part of the lawsuit still stands.
