What I have been saying on other threads is… I am pretty sure Epic has always known this case is a weak case based on prior court cases not defining this as an anti-trust case (i.e. not an ‘illegal monopoly’ based on existing precedence of defining the market in a rather wide manner not a vendors own marketplace for a closed environment). This is a battle I think Epics lawyers have said will not be won in the courts (unless there is a surprise), and if it is won, it would likely be overturned later…. In the end though, it was about winning the war… and for that to happen they would need the intervention of Congress (or EU etc.)… and all the courtroom theatrics of trying to embarrass Apple…. was with that in mind. (though in this case Tim Cook embarrassed himself – in pretending he was a CEO [known for being detailed as required for logistics… and for some reason pretending he would not know all the numbers of major growth centers for the company]
